Dominick Evans is fighting one heck of a battle, to keep his wheelchair. The 27 year old, who has Spinal Muscular Atrophy Type III was rejected twice by Medicare, who claims he can both walk and stand, things he's been unable to do since 1996 and 2002 respectively.

Ignoring his diagnosis information and other documents submitted by MDA, the insurance company has left him no choice but to appeal to the Supreme Court. They appointed a doctor and nurse, who never met or spoke to Dominick, to determine whether he could walk/stand, or not. While he was approved for a similar chair back in 2002, Medicare claims he has miraculously gotten better (from a progressive muscle disease) and no longer needs the wheelchair he has.

Thanks for posting this elusive. As an update, Senator Debbie Stabenow (of Michigan) is sending Medicare a letter on my behalf. She's a great person who has helped me out before, so hopefully at her urging I'll get to keep my wheelchair!
